Welcome to Who Just Served?

These Terms and Conditions ("Terms") govern your access to and use of whojustserved.com, the Who Just Served? web application, mobile application, and any related services, features, content, communications, or platforms we provide (collectively, the "Service").

Throughout these Terms, "Who Just Served?," "WJS," "we," "us," and "our" refer to Who Just Served?. "You" and "your" refer to anyone who visits, accesses, registers for, or uses the Service.

By accessing or using Who Just Served?, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. What Is Who Just Served?

Who Just Served? is a pickleball platform designed to help players connect, play, record games, track scores and statistics, participate in events, discover courts, interact with other players, and enjoy other pickleball-related features.

Features may include:

  • Player profiles

  • Game and score tracking

  • Player statistics

  • Partners and opponent history

  • Court information

  • Events and round robins

  • Rankings and leaderboards

  • Achievements and awards

  • Player invitations

  • Photos and other user-generated content

  • Notifications and communications

  • Virtual rewards or recognition

  • Coaching, clinics, instructional opportunities, or other pickleball-related experiences

  • Additional features introduced in the future

We may add, modify, remove, test, or discontinue features as Who Just Served? develops.

2. Eligibility

You must be legally permitted to use the Service and agree to these Terms.

Who Just Served? is not intended for children under 13.

If you are under the age of majority where you live, you should use the Service only with the permission and supervision of a parent or legal guardian where required by law.

Certain events, competitions, or features may have additional eligibility requirements, including age, skill level, location, or other participation requirements.

3. Creating an Account

Some Who Just Served? features require an account.

When creating or maintaining an account, you agree to provide accurate information and keep that information reasonably current.

Account information may include your:

  • Name

  • Mobile phone number

  • Username or user ID

  • Profile photo

  • Month and year of birth

  • Home court

  • Pickleball skill level or rating

  • Other profile information

You are responsible for activity associated with your account and for maintaining appropriate control over devices used to access your account.

You may not impersonate another person, create an account using false information, intentionally create duplicate accounts to manipulate Who Just Served?, or access another person's account without authorization.

4. Phone Verification and Communications

Who Just Served? may use mobile phone numbers for account creation, authentication, identity verification, player invitations, fraud prevention, security, and communications related to the Service.

By providing your mobile number and requesting or agreeing to applicable communications, you authorize Who Just Served? and its service providers to send messages necessary to provide those features.

Messages may include:

  • Verification codes

  • Security messages

  • Player invitations

  • Game notifications

  • Score confirmation requests

  • Event information

  • Round robin information

  • Account notifications

  • Other service-related communications

Message and data rates may apply. Message frequency may vary.

Consent to receive promotional SMS messages, if Who Just Served? ever offers them, is not a condition of purchasing goods or services.

Instructions for opting out of applicable SMS communications will be provided where required.

5. Games, Scores and Statistics

Who Just Served? allows users to record pickleball games and related information.

Users agree to make a reasonable effort to submit accurate information, including:

  • Players

  • Teams

  • Scores

  • Winners and losers

  • Courts

  • Events

  • Game results

Who Just Served? may use confirmation systems that allow opponents, partners, organizers, or other authorized users to verify game results.

Statistics, rankings, achievements, awards, ratings, streaks, records, and other calculations may be generated from information submitted through the Service.

While we strive to provide accurate information, Who Just Served? does not guarantee that every score, statistic, ranking, calculation, rating, record, or result will always be accurate or complete.

Errors happen. It is pickleball, not the Federal Reserve.

We may correct, remove, invalidate, or adjust games, statistics, rankings, records, or other information when we reasonably believe information is incorrect, fraudulent, duplicated, manipulated, or otherwise inconsistent with the intended use of the Service.

6. Fair Play and Statistical Integrity

Who Just Served? is built around legitimate pickleball participation.

You agree not to:

  • Submit games that did not occur

  • Intentionally submit false scores

  • Manipulate wins, losses, statistics, rankings, streaks, achievements, or rewards

  • Create fake players or accounts

  • Coordinate with others to manipulate statistics

  • Repeatedly submit duplicate games

  • Misrepresent your participation in an event

  • Abuse confirmation systems

  • Exploit bugs or technical errors for competitive advantage

  • Manipulate Who Just Served? systems in ways inconsistent with their intended purpose

We reserve the right to investigate suspicious activity and correct or remove affected records.

Accounts engaged in intentional manipulation may be restricted, suspended, or terminated.

7. Players Without Accounts

Certain features may allow registered users or event organizers to identify players who have not yet created a Who Just Served? account.

This may allow legitimate games or event participation to be recorded while giving that player an opportunity to create an account later and connect with applicable activity.

You agree not to use this feature to create fictitious players, impersonate others, harass someone, or submit another person's information for purposes unrelated to legitimate pickleball activity.

8. Courts and Locations

Who Just Served? may provide information about pickleball courts, facilities, parks, clubs, churches, recreation centers, or other playing locations.

Court information may come from users, publicly available information, third-party services, mapping providers, facility operators, or other sources.

Who Just Served? does not guarantee that court information is complete or current.

Court availability, hours, fees, rules, ownership, access requirements, reservation requirements, surface conditions, lighting, amenities, or other information may change without notice.

The appearance of a court or facility within Who Just Served? does not necessarily indicate endorsement, sponsorship, partnership, or authorization by that facility.

You are responsible for following the rules and requirements of any location where you play.

9. Events and Round Robins

Who Just Served? may allow users or organizers to create and manage events, open play sessions, round robins, leagues, tournaments, clinics, or other pickleball activities.

Event organizers are responsible for the information they provide, including:

  • Date and time

  • Location

  • Player eligibility

  • Number of participants

  • Number of courts

  • Skill requirements

  • Format

  • Scoring

  • Rules

  • Fees, if applicable

  • Cancellations

  • Other event requirements

Unless explicitly stated otherwise, Who Just Served? is a technology platform and is not necessarily the organizer, owner, sponsor, or operator of events created by users.

Participation in an event does not guarantee a particular number of games, partners, opponents, court assignments, playing time, or outcome.

Organizers may establish additional rules for their events, provided those rules do not conflict with applicable law or these Terms.

10. Skill Levels and Ratings

Who Just Served? may allow players to identify a skill level or may generate ratings, estimates, statistics, or other measures based on activity within the Service.

These measurements are intended primarily for recreational, informational, organizational, or entertainment purposes unless specifically stated otherwise.

A Who Just Served? rating or statistic may not correspond directly with ratings issued by other pickleball organizations, leagues, clubs, rating systems, or governing bodies.

We do not guarantee that a particular rating accurately represents a player's ability in every circumstance.

11. Photos and User-Generated Content

Who Just Served? may allow you to upload photographs, profile images, comments, descriptions, event information, court information, or other content ("User Content").

You retain ownership of content you create and own.

By submitting User Content to Who Just Served?, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, format, and otherwise use that content as reasonably necessary to operate, promote, improve, and provide the Service.

You represent that you have the right to submit the content you upload.

You may not upload content that:

  • Violates another person's intellectual property rights

  • Violates another person's privacy rights

  • Is unlawful

  • Is fraudulent or intentionally misleading

  • Is threatening or harassing

  • Contains malicious software

  • Is obscene or otherwise inappropriate for the Service

  • Exploits or endangers minors

  • Is submitted primarily to disrupt or abuse Who Just Served?

We may remove User Content that violates these Terms or that we reasonably determine is inappropriate for the Service.

12. Interactions With Other Users

Who Just Served? helps people connect around pickleball.

We are not responsible for the conduct of individual users.

You are responsible for exercising reasonable judgment when interacting with people you meet through the Service.

You agree not to use Who Just Served? to:

  • Harass or threaten another person

  • Stalk another person

  • Discriminate unlawfully

  • Send unwanted or abusive communications

  • Impersonate another person

  • Collect personal information improperly

  • Engage in fraudulent activity

  • Promote illegal activity

  • Interfere with another person's ability to use the Service

We may restrict or terminate accounts that violate these standards.

13. Physical Activity and Assumption of Risk

Pickleball and other athletic activities involve inherent risks.

These risks may include falls, collisions, physical contact, equipment failure, court conditions, overexertion, dehydration, muscle or joint injuries, serious bodily injury, and other risks associated with physical activity.

Who Just Served? provides technology related to pickleball participation but does not control the physical conditions under which users play.

By choosing to participate in pickleball or an activity discovered, organized, recorded, or facilitated through Who Just Served?, you acknowledge that participation is voluntary and involves inherent risks.

You are responsible for determining whether you are physically capable of participating and whether a court, facility, event, or activity is appropriate for you.

If you have questions about your ability to participate safely in physical activity, consult an appropriate medical professional.

14. Coaching and Instruction

Who Just Served? may provide access to coaches, instructors, clinics, lessons, training opportunities, or other instructional experiences.

Unless specifically stated otherwise, individual instructors are responsible for their own coaching services, qualifications, schedules, instruction, and conduct.

Participation in coaching or instruction does not guarantee improvement, ratings increases, tournament results, competitive success, or any particular outcome.

15. Virtual Items, Points, Rewards and "Pickles"

Who Just Served? may offer virtual points, achievements, rewards, badges, or other digital items, including items that may be called "Pickles."

Unless we specifically state otherwise:

  • Virtual items have no cash value

  • They are not legal currency

  • They are not cryptocurrency

  • They cannot be redeemed for cash

  • They do not represent ownership in Who Just Served?

  • They are not investments

  • They may not be sold or transferred outside systems we specifically authorize

Who Just Served? may establish, modify, limit, expire, correct, or discontinue virtual reward systems.

We may remove virtual items obtained through fraud, manipulation, technical errors, or abuse.

If we later permit virtual items to be exchanged for discounts, merchandise, services, entries, or other benefits, additional terms may apply.

16. Purchases and Paid Services

Who Just Served? may offer paid services, event registrations, coaching experiences, subscriptions, premium features, merchandise, or other purchases.

Prices and applicable terms will be disclosed before purchase.

Additional payment, cancellation, refund, subscription, or event-specific terms may apply to particular purchases.

Payments may be processed by third-party payment providers. Who Just Served? may not directly receive or store complete payment-card information when payment processing is handled by those providers.

17. Intellectual Property

Who Just Served? and its associated software, design, branding, logos, graphics, text, features, interfaces, databases, and original content are owned by Who Just Served? or its licensors and are protected by applicable intellectual property laws.

Except for rights expressly granted under these Terms, no rights are transferred to you.

You may not copy, reproduce, distribute, sell, license, reverse engineer, scrape, systematically extract, or create derivative works from protected portions of the Service except as permitted by law or with our written permission.

"Who Just Served?" and associated branding may be trademarks or other protected identifiers of Who Just Served?.

18. Acceptable Use

You agree not to:

  • Use the Service unlawfully

  • Attempt unauthorized access to accounts or systems

  • Circumvent security features

  • Introduce viruses or malicious code

  • Interfere with operation of the Service

  • Use automated systems to scrape or extract information without authorization

  • Attempt to discover passwords, authentication codes, or security credentials belonging to another person

  • Abuse messaging or invitation systems

  • Use Who Just Served? to distribute spam

  • Manipulate platform features or rewards

  • Use the Service in a way that harms Who Just Served?, its users, or third parties

19. Third-Party Services

Who Just Served? may use or integrate with third-party services, including services related to:

  • SMS and phone verification

  • Maps and location information

  • Hosting

  • Databases

  • Authentication

  • Analytics

  • Payment processing

  • Application distribution

  • Other technical services

Your use of certain third-party features may also be subject to the terms and privacy policies of those providers.

Who Just Served? is not responsible for third-party services outside our reasonable control.

20. Account Suspension or Termination

We may restrict, suspend, or terminate access to Who Just Served? if we reasonably believe that:

  • You violated these Terms

  • Your account is being used fraudulently

  • Your activity threatens the security or integrity of the Service

  • You are abusing other users

  • You are manipulating games, statistics, rankings, rewards, or other systems

  • Suspension or termination is reasonably necessary to protect Who Just Served? or others

  • We are legally required to do so

You may stop using Who Just Served? at any time and may request account deletion as described in our Privacy Policy.

21. Availability and Changes to the Service

We want Who Just Served? to work reliably, but we cannot guarantee uninterrupted access.

The Service may occasionally be unavailable because of:

  • Maintenance

  • Technical problems

  • Internet outages

  • Third-party service interruptions

  • Updates

  • Security concerns

  • Events outside our reasonable control

We may modify, update, suspend, or discontinue all or part of the Service.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Who Just Served? is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • The Service will always be available

  • The Service will be error-free

  • Every score or statistic will be accurate

  • Court information will always be current

  • Users will behave appropriately

  • Events will occur as described

  • A particular feature will remain available

  • Use of the Service will produce any particular result

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Who Just Served? and its owners, operators, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service.

This includes, where permitted by law, losses related to:

  • Use or inability to use the Service

  • Incorrect scores or statistics

  • User conduct

  • Events

  • Court or facility conditions

  • Physical injury associated with pickleball participation

  • Lost data

  • Unauthorized account access

  • Third-party services

  • Interruptions or technical failures

Nothing in these Terms limits liability that cannot legally be limited or excluded.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Who Just Served? and its owners, operators, employees, contractors, and affiliates from claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful use of the Service, your violation of these Terms, your User Content, or your violation of another person's rights.

25. Privacy

Your privacy is important to us.

Our collection and use of personal information is described in the Who Just Served? Privacy Policy, available through our website and applicable Who Just Served? applications.

By using the Service, you acknowledge that you have had an opportunity to review the Privacy Policy.

26. Changes to These Terms

We may update these Terms as Who Just Served? develops, adds features, changes business practices, or responds to legal requirements.

When we make changes, we will update the "Last Updated" date.

For significant changes, we may provide additional notice through the website, application, email, SMS, or another appropriate method.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

27. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from these Terms or the Service will be handled in an appropriate court with jurisdiction in North Carolina unless applicable law requires a different venue or the parties agree to another dispute-resolution process.

28. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

29. Entire Agreement

These Terms, together with the Who Just Served? Privacy Policy and any additional terms presented for specific features, purchases, events, or services, constitute the agreement between you and Who Just Served? regarding use of the Service.
